Registration Requirement
With the aim of safeguarding the continuity and integrity of our social security system in Aruba, the Social Security Bank (SVb) requests your cooperation for the following.
The SVb has identified an incorrect administrative pattern. This practice involves the employer terminating the registration of his employees with the SVb in December, only to re-register those same employees in January, without there being a formal termination of the employment contract.
This practice is a violation of the Landsverordening Ziekte- and Ongevallenverzekering and also the Landsverordening Cessantia.
The SVb is determined to combat these incorrect practices. As soon as the SVb detects this, necessary corrections will be implemented and measures will be taken:
1. Administrative Fine:
A fine will be imposed for detected violations. The provision of incorrect or incomplete information is an offense that is punished by imposing an administrative fine on the company that commits these violations. The maximum fine for this can amount up to Afl. 500,000,- per violation.
2. Collection of ZV, OV and Cessantia Premiums:
Premiums that were not paid for the evaded periods (namely December and January) will be charged retroactively.
SVb trusts that all employers will continue to comply with their legal obligations and where applicable will implement the necessary changes in administrative procedures to prevent a situation as described here.
