Handling of an administrative fine

By law, every employee residing in Aruba must be registered with SVb to be insured for health and accident insurance. If the employer does not allow enrolling in SVb, he deprives the employee of insurance protection. In addition, he is committing fraud because he does not pay the premium for the insurance. With managing administrative fines, SVb has more authority to address these problems. Every employer must give complete and correct information and comply with the enrollment of their employees in SVb. For non-compliance with these obligations, SVb can issue an administrative fine.

The sum of the administrative fine

If SVb finds an infraction, SVb uses different guidelines when handling the administrative fine to determine whether to issue a fine and how high it can be. This handling determines how the administrating fine is applied as in the National Health Insurance Ordinance and National Accident Insurance Ordinance. Among others, it is determined:

  • Who gives the fine?
  • How to give the fine?
  • When the fine expires?
  • How the amount of the fine is determined.

This handling is to ensure that the law is applied proportionally and uniformly.

Individual cases

When determining the fine, the SVb must consider each case individually and must act within the principle of proportionality “evenredigheidsbeginsel.” It means that when determining the fine, it must consider the gravity of the infringement, the culpability of the employer, and the circumstances of specific cases.

Sums of fines by categories

Firstly, SVb will not give a fine of the maximum sum of AWG. 500,000, -, but it does give lower sums. It is not ruled out that the sums may be adjusted if they do not have the desired effect in the future. All sums can be categorized according to the three tables:
